What Types Of Benefits Can You Receive Under NY’s Workers’ Comp System?

In New York, the workers’ compensation system is a lifeline for those injured on the job. The money you receive could help you keep up with bills, medical treatments, and anything else you need while recovering. However, every case is different, and you won’t know which workers’ comp benefits you’re eligible for until after the Board makes a decision. This guide will give you an overview of the benefits available and what to expect.

Types Of Benefits Available Under NY’s Workers’ Comp

Medical Benefits

One of the most crucial benefits workers’ compensation offers is free medical care for any relevant workplace injuries. In most cases, your employer or their insurance company is responsible for the bill. Some treatments you could receive include:

  • Emergency care
  • CT scans
  • Doctors’ visits
  • Physical therapy
  • Prescriptions
  • Surgeries or other invasive medical procedures
  • Special equipment

Despite these advantages, the system has its limits. Besides initial emergency care, anyone who qualifies can only go to specific doctors under the Workers’ Compensation Board’s network. Visiting a doctor outside may force you to cover the costs out of pocket. Always follow the Board’s guidelines to avoid any issues down the line.

Lost Wages

You’ll probably need to take time away from work while you recover if you sustain serious injuries. New York’s system offers up to two-thirds of your weekly wages if you miss over seven work days or work fewer hours. Depending on your case’s details, you might also receive a Schedule Loss of Use Award as part of your settlement.

The amount you receive will depend on your injuries. An independent medical examiner will give you a disability score ranging from 0 to 100%, the latter meaning total disability. The higher your score, the larger your weekly wage will be. In 2024, the maximum you could receive is  $1,171.46 for partial and permanent disabilities.

Survivor Benefits

If you pass away from your injuries, your spouse and other dependents could qualify for cash benefits under state law. They’re eligible to receive up to two-thirds of what your weekly salary was the year before your death. So, if you received a salary of $1000 per week, your spouse would receive a weekly benefit of $600.

Besides cash benefits, the state could cover between $10,500 and $12,500 in funeral expenses, depending on where they live. Your parents or the family estate could also receive up to $50,000 in compensation if you weren’t married or had any dependents.
