Off The Record – TRR Workers’ Comp Maximum Benefit Rate Increase

Hey, this is Bill Turley from Turley Redmond & Rosasco. And it’s that time of year again. And when I say that, I mean, it’s time for a rate increase at workers’ compensation. So, tomorrow, July 1st, 2022, the maximum benefit rate for total disability and for partial disability is $1,125 dollars and 46 cents. It’s currently $1,063 and five cents. And typically, every year on July 1st, the rate goes up. And it is based upon the statewide average of average weekly salaries.

So, the statewide average from Montauk to Buffalo, whatever that is, this is two-thirds of that. And that is the maximum benefit that is paid. So, as you know, I’ve talked about this before. Your benefit rate is based upon your average weekly wage. And so if you’re considered totally disabled, you are entitled to a maximum of, as of tomorrow, it’ll be $1,125 dollars and 46 cents or two-thirds of your average weekly wage, okay?

So, to give you an idea as to how long I’ve been doing this, when I first started in worker’s compensation, the maximum benefit rate was $275 dollars a week. My, how times have change.
