Off The Record – Workers’ Comp Do You Always Need an Attorney?

Hi, this is Bill Turley from Turley Redmond & Rosasco.

You know, a lot of people have asked me lately if it is absolutely necessary to have a lawyer in a Workers’ Compensation case. And the short answer is, “No, not all the time.” If you have a fairly minor injury and you have very little medical care, you don’t lose much time from work, and everything gets taken care of, in other words, your medical bills get paid, you get paid for the lost time that you had from work as a result of the injury, you don’t necessarily need a lawyer. But anything complicated, anything where you lose a lot of time from work, or you have extensive medical bills, you absolutely should consult with an attorney.

But here’s the thing. A lot of times, there are some hidden benefits that you don’t know about, that only a lawyer will be able to tell you about. So, I would say, anytime you get hurt at work, it’s a good idea to consult with an attorney. The consultation is free, and again, they can find hidden benefits, things that not everyone is aware of. Okay?

So, for example, let’s say you fracture your wrist, but you have the kind of job where you can come in every day with that cast and still be able to do your job. Well, most people will say, “Well, I didn’t lose any time from work. They covered all my medical bills. Why do I need a lawyer?” Well, the thing is there that, if you have any kind of residuals from that fractured wrist, if you have any kind of permanent loss of function, you might still be entitled to a lump sum award once you’re done with all of your treatment.
