What You Need to Know about New York Workers' Compensation Arm Injuries

Workers' Compensation arm injuries are some of the most common injuries for workers in NYC and Long Island. So what do you need to know to get all the medical treatment and the maximum cash award for your arm injury?

If you have one or more of the below arm injuries, you may be entitled to a tax free cash award from the New York State Workers' Compensation Board. Our lawyers help injured workers with these injuries every day:

  • Torn rotator cuffs of the shoulders
  • Shoulder sprains and strains
  • Shoulder impingements or "frozen shoulders"
  • Shoulder labrum tears
  • Shoulder AC Joint Separations
  • Collar bone (Clavicle) dislocation and fractures
  • Ruptured bicep muscles and tendons
  • Elbow dislocations and fractures (distal humerus, radius and ulna fractures)
  • Tendinitis, "tennis elbow" (Lateral epicondylitis) and bursitis
  • Distal radius fractures of the forearm
  • Broken bones of the arms
  • Arm Crush injuries
  • Severed arm tendons
  • Arm amputations
  • Brachial Plexus Injuries

Cash awards for permanent arm injuries are determined by a special chart used by the New York Workers' Compensation Board. This chart is known as the "Schedule Loss of Use" chart and it determines how much money you will get at the end of your legal case. Arm injuries are based upon a percentage of the permanent "total loss of use of the arm" (for example, amputation of the arm above the elbow). In New York, the 100% total loss of use of an arm is worth 312 weeks of workers compensation benefits.

In most cases, your permanent percentage loss of use award (also known as an "SLU Award" will be less, but your workers' compensation lawyer should fight the insurance company to get you the maximum tax-free award possible. Our office has negotiated awards of over $100,000.00 for our clients with severe arm injuries due to accidents on the job. After you receive your tax free award, if your condition worsens, your case can be re-opened in the future for more medical care and a potential increase in your award.

We hope this information was helpful in understanding how the New York Workers' Compensation Board determines final awards for arm injuries. If you have questions or need representation in your workers' compensation accident, please call us at 1-800-671-4927 for a Free Consultation.
